These terms and conditions apply to the Early Years Learning Hub web site located at earlyyearslearninghub.com.au. By using this site, you signify your consent to these Terms and Conditions. If you don not agree with all of these terms and conditions do not use the site.

These terms and conditions also apply to the use of and access to all professional learning, resources, membership and online networking. They should be read in conjunction with the Privacy policy. Please read through these terms before making a purchase. By continuing with a transaction and making a purchase we consider that you have read and accepted the terms as laid out below.

The Early Years Learning Hub reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms and Conditions at any time. It is your responsibility to check these Terms and Conditions periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms and Conditions, the Early Years Learning Hub grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the site.

Copyright and trademarks

All of the materials appearing on this site, including but not limited to the Website design, text elements, brands, names, logos, designs including artwork/illustrations, materials, photographs, images, icons etc., as well as the selection, assembly and arrangement thereof, are the sole property of the Early Years Learning Hub or their respective owners. All rights not expressly granted herein are reversed. Except as otherwise required by applicable law, any reproduction, distribution, modification, retransmission or publication of any copyrighted material is strictly prohibited without the expressed written consent of the copyright owner.

Intellectual property

The Intellectual Property of the Early Years Learning Hub including all materials on the website, professional learning, resources, membership and online networking shall remain the property of the Early Years Learning Hub indefinitely and shall be kept confidential indefinitely, unless with the prior written consent from Jacqui Ward, managing director of the Early Years Learning Hub.

Accuracy of information

Material is provided on this website on the basis that you will assess and verify the material and any representations or statements obtained from this website before use. Changes in circumstances, after material is placed on this website, may impact the accuracy of the material. To the fullest extent permitted by law, the Early Years Learning Hub is not liable to you arising from your use of, or reliance on, any material or advice obtained from this website.

Limitation of liability and indemnity

We exclude, to the maximum extent permitted by law, any liability in connection with your use of our website and its content. We are not responsible for any Loss or Damage suffered in connection with your use of our website, its content, any interruptions, changes, suspension or termination of our website or any events beyond our control.

You indemnify us for any claim arising out of or in connection with any third-party links, websites, apps, software, products and services; your breach of this Agreement, your breach of the law including your local laws, or your breach of the rights of a third party.

Personal and non-commercial use of our content

Right to remove online materials

The Early Years Learning Hub reserves the right to withdraw from the materials provided through Early Years Learning Hub web site or the online networking platform any item or part of an item that it no longer retains the right to publish, or which it has reasonable grounds to believe infringes copyright, or is otherwise offensive, defamatory or erroneous. In such event, the Customer will be required to delete the material(s) and destroy all paper and electronic copies immediately.

Purchases

You warrant that all details you provide to the Early Years Learning Hub for the purpose of ordering or purchasing products and services are true, accurate, current and complete in all respects; and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover the payment of the product(s) ordered.

Setting up an account

By setting up a user-account, you grant the Early Years Learning Hub ongoing consent to receive promotional and marketing information regarding relevant products and services of Early Years Learning Hub, unless you actively opt out of receiving such communication.

Payment

The Early Years Learning Hub accepts most major credit and debit cards via Stripe. All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Pricing

All pricing is in Australian dollars and GST is included at the checkout. Prices are subject to change without prior notification.

Returns and refunds

The Early Years Learning Hub handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.  Please note that we do not offer refunds on any of our products or services due to change of mind so please choose carefully.

License agreement

Purchasers automatically enter into a Licence Agreement with the Early Years Learning Hub once the purchase is complete. All resources are copyright protected and are the property of the Early Years Learning Hub. Any sharing, copying, installing, accessing or otherwise using the Early Years Learning Hub professional learning, resources and associated materials, is a breach of this Licence Agreement. Purchasers are responsible for ensuring that the terms and conditions of this Licence Agreement are adhered to fully. Failure to abide by these terms and conditions, or violate any other terms of this Licence Agreement, will result in termination access to its electronic resources immediately and without notice, in addition to any other available remedies.

The materials provided through The Early Years Learning Hub may NOT be used for any; fee-for-service use, including providing access to or selling copies of items, systematic supply or distribution of portions of, or items from, the online version of the materials in any form or similar commercial or marketing activity.

Conditions of Membership

All new membership requests will be reviewed by our membership specialist. New members will be granted membership and access once membership is approved. All members are required to indicate they accept all terms and conditions of membership.

By becoming a member of the Early Years Learning Hub you consent to us contacting you from time to time for the purposes of communication using means including, but not limited to letter, email, telephone (including SMS services) and social media.

Transfer of Membership

The Early Years Learning Hub memberships are non-transferable.

Upgrade of Membership

Where a member wishes to change or upgrade their membership to a different membership package, they can do so by email to info@earlyyearslearninghub.com.au

Re-instate a Lapsed Membership

To re-instate your lapsed membership (up to 12 months or any time after membership fees were due) simply sign up for membership again on the Early Years Learning Hub website.

Resigning a Membership

Members wishing to resign their membership during the membership period are required to do so in writing, by mail or email. Please include your full name and contact details via email to info@earlyyearslearninghub.com.au.  Membership fees are non-refundable for the period signed up for (monthly or yearly). Please allow 2 weeks’ notice prior to the end of the period you have paid for.

Membership Fees

The monthly or annual membership fee payable in advance of the member’s renewal date each month or year. These fees will continue to be deducted form the members designated account unless and until membership is resigned.

Failure to Pay

If a member does not pay their Membership fees, their Membership will lapse, and they will not have access to membership benefits and will be removed from the online Teams space.

Costs Incurred in Processing Membership Fees

If the Early Years Learning Hub incurs any unexpected costs in processing membership fees, those costs will be charged back to that member. Costs may include but are not limited to related bank charges.

Membership Refunds

Membership fees will not be refunded.

To be respectful when posting

We encourage you to engage in online discussions in our online community, website and social media sites however, we do not recommend that you include any personal information such as your email address or physical address in any posts. When you engage in discussions, your posts will not be confidential, and you must comply with our posting rules. You must not post any of the following, which is determined at our discretion:

  • any disrespectful, inappropriate, offensive, threatening or abusive content
  • any content that breaches the rights of a third party (e.g. which is defamatory)
  • any content that impersonates any other person, or misleads us as to the origin of your posts; or
  • any advertising, self-promotion or sales.

Where posts do not comply with these rules, or are otherwise objectionable, we may, but are not obliged to remove them and discontinue your membership. You are solely responsible for all your posts.

It is essential that all Early Years Learning Hub products, services and membership are used only in the manner for which they are intended, and that care and common sense are used. To the extent permitted by law the Early Years Learning Hub does not accept any liability for any damage or injury caused by the use or misuse of our products from our range and/or products ordered from this site.
